1. Definitions
- “We”, “Us”, “Our” refers to Modbox Pty Ltd.
- “You”, “Client”, “Customer” refers to the person or business purchasing or using our products or services.
- “Goods” refers to the modified shipping containers provided by Modbox.
- “Services” refers to design, delivery, installation, and after-sales support provided by Modbox.
2. Quotations & Orders
- All quotes are valid for 30 days unless otherwise specified.
- Quotes are based on the specifications provided by the Client. Changes to these specs after acceptance may result in additional charges.
- A signed order confirmation or deposit payment constitutes acceptance of the quote and these terms.
3. Payments
- A deposit of 50% is required to commence work on your project.
- Final payment is due prior to delivery unless otherwise agreed in writing.
- Late payments may incur additional fees, and we reserve the right to withhold delivery or services until payment is received in full.
4. Delivery & Installation
- Delivery dates are estimates and may vary due to factors outside our control.
- The Client must ensure the delivery site is accessible and prepared (e.g., flat and stable ground). Additional charges may apply for delays or site access issues.
- Installation is carried out as per the agreed scope. Any changes during or after installation may incur additional charges.
5. Warranty & After-Sales Support
- Our containers come with a one-year warranty covering structural defects caused by manufacturing or installation.
- The warranty does not cover misuse, unauthorised modifications, or normal wear and tear.
- For warranty claims or support, please contact us directly.
6. Cancellations & Refunds
- Cancellations must be made in writing.
- Deposits are non-refundable unless agreed otherwise in writing.
- If the project is cancelled after work has commenced, the Client may be liable for costs incurred up to that point.
7. Liability
- Modbox is not liable for any damages, delays, or costs resulting from circumstances beyond our control (e.g., weather, transport delays).
- Modbox is not responsible for site preparation, permits, or approvals unless specifically agreed in writing.
- Clients are responsible for ensuring the containers comply with local regulations and site requirements.
8. Intellectual Property
- All designs, plans, and concepts provided by Modbox remain our intellectual property unless otherwise agreed in writing.
9. Governing Law
- These terms and conditions are governed by the laws of NSW, Australia.
